If you are entering into this agreement on behalf of a company, enterprise, or other legal entity, you represent and warrant that you have the authority to bind such entity and its affiliates to these terms. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not access or use the services.

THELINKAI PRIVATE LIMITED provides VCMO—an intelligent B2B business development and marketing platform engineered to unify fragmented sales and marketing operations into a cohesive system.

The services include, but are not limited to, the following core platform modules and operational workflows:

Permission is granted to temporarily use THELINKAI PRIVATE LIMITED services for personal, non-commercial transitory viewing only when accessing public marketing pages.

For registered enterprise accounts, pilot participants, and active subscribers, THELINKAI PRIVATE LIMITED grants a non-exclusive, non-transferable, revocable, limited license to access and operate the VCMO platform strictly for your internal business development, sales, and marketing operations in accordance with your commercial subscription tier.

Under this license, you may not:

To access certain platform modules, you must register for an enterprise account. You agree to provide accurate, current, and complete information during registration and keep your account details updated.

You are responsible for safeguarding your login credentials, API keys, and multi-factor authentication tokens. You must notify THELINKAI PRIVATE LIMITED immediately at info@thelinkai.com upon becoming aware of any unauthorized use of your account or security breach.

You remain fully responsible for all activities, data transactions, and outreach campaigns executed under your authorized user credentials.

As between the parties, you retain complete ownership, title, and all intellectual property rights in and to the data, contacts, opportunity records, files, and materials you upload or import into the VCMO platform ('Customer Data').

THELINKAI PRIVATE LIMITED accesses Customer Data solely to provide, operate, maintain, and support the platform for your organization, or as required by applicable law.

We implement enterprise-grade technical, physical, and administrative safeguards designed to protect Customer Data from unauthorized disclosure or access.

VCMO incorporates state-of-the-art artificial intelligence models to assist with lead scoring, proposal drafting, market synthesis, email formulation, and content creation.

AI-generated outputs represent probabilistic suggestions designed to accelerate expert human workflows. Because AI technologies evolve rapidly and can occasionally produce inaccuracies or incomplete information, you agree to inspect, review, and verify all AI-generated content before relying upon it or sending it to third parties.

VCMO provides email marketing, outreach automation, and communication workflows. In using these tools, you agree to comply with all applicable laws and regulations governing electronic communications, including but not limited to the CAN-SPAM Act, the General Data Protection Regulation (GDPR), the Information Technology Act 2000, and local anti-spam regulations.

You expressly agree not to:

All right, title, and interest in and to the VCMO platform—including software architecture, design systems, visual assets, codebases, user interfaces, documentation, trade secrets, and algorithms—are and will remain the exclusive property of THELINKAI PRIVATE LIMITED and its licensors.

'The Link AI', 'VCMO', the company wordmark, and the stylized brand logos are trademarks of THELINKAI PRIVATE LIMITED. You may not use our trademarks, brand names, or logos without our prior written permission.

Any feedback, suggestions, or ideas you provide regarding the service may be used by THELINKAI PRIVATE LIMITED without any obligation of compensation or confidentiality to you.

The materials on THELINKAI PRIVATE LIMITED's services are provided on an 'as is' and 'as available' basis. THELINKAI PRIVATE LIMITED makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, THELINKAI PRIVATE LIMITED does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this service.

We do not warrant that the platform will be uninterrupted, error-free, completely secure, or free from viruses or other harmful components, though we employ commercially reasonable security measures to maintain high platform availability.

In no event shall THELINKAI PRIVATE LIMITED, its directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any indirect, incidental, punitive, special, or consequential damages (including, without limitation, damages for loss of data, loss of profits, loss of business revenue, business interruption, or loss of goodwill) arising out of the use or inability to use the materials or services on THELINKAI PRIVATE LIMITED's platform, even if THELINKAI PRIVATE LIMITED or an authorized representative has been notified orally or in writing of the possibility of such damage.

To the maximum extent permitted by applicable law, THELINKAI PRIVATE LIMITED's total aggregate liability arising out of or related to these terms or your use of the services shall not exceed the amount actually paid by you to THELINKAI PRIVATE LIMITED for the specific service giving rise to the claim during the twelve (12) months preceding the event giving rise to liability.

THELINKAI PRIVATE LIMITED has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by THELINKAI PRIVATE LIMITED of the site.

These terms remain in full force and effect while you access or use THELINKAI PRIVATE LIMITED services. We reserve the right to suspend or terminate your account or access to the platform immediately, without prior notice or liability, if you breach any provision of these terms, fail to pay applicable subscription fees, or engage in activity harmful to our infrastructure or other users.

Upon termination of your subscription or pilot agreement, your right to use the platform ceases immediately. Upon request received within thirty (30) days of termination, we will make your Customer Data available for standard export before permanent decommissioning in accordance with our data retention schedule.

Provisions of these terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, limitations of liability, and governing law.

Any claim relating to THELINKAI PRIVATE LIMITED's website, products, or services shall be governed by the laws of India, without regard to its conflict of law provisions.

You agree that any dispute, controversy, or claim arising out of or relating to this agreement shall first be subject to good-faith informal negotiations between the parties for a minimum period of thirty (30) days.

If unresolved through negotiation, the dispute shall be submitted to the exclusive jurisdiction of the competent courts having jurisdiction over the registered office of THELINKAI PRIVATE LIMITED.

THELINKAI PRIVATE LIMITED may revise these Terms of Service for its website and platform at any time without prior notice. By using this website and platform you are agreeing to be bound by the then-current version of these Terms of Service.

For material modifications affecting active enterprise subscriptions, we will provide reasonable advance notice by posting an announcement within the platform, sending an email to the primary administrator address on file, or updating the 'Last Updated' date at the top of this page.
